Welcome to DIY Toolshare (“we”, “us”, “our”). These Terms of Service (“Terms”) set out the rules for using our website and services. By using DIY Toolshare, you agree to these Terms. If you don’t agree, please don’t use our services.
We operate solely within the United Kingdom.
1. Our Service
DIY Toolshare is an online platform that connects people who want to borrow tools with people who want to lend or rent tools. We do not own, supply, or inspect the tools listed on our site.
2. Accounts
- You must be 18 or older to create an account.
- You’re responsible for keeping your account details secure.
- You must provide accurate, current, and complete information.
3. Listings & Wishlists
- Tool Owners: You can list tools you are willing to rent out. You must provide honest descriptions and ensure tools are safe and in good working order.
- Borrowers: If you can’t find a tool, you may post a Wishlist request.
- All users must act respectfully and responsibly in any communication.
4. Rentals & Payments
- All rentals must be processed through DIY Toolshare’s payment system.
- We charge a 20% commission (minimum £0.50) on each transaction.
- Prices, rental periods, and pickup/return details are agreed directly between the owner and borrower via the platform.
- Payment is taken at booking and released to the owner after the rental is complete.
5. Tax Responsibility
If you earn income by renting out tools through DIY Toolshare, you are solely responsible for determining whether that income is taxable and for declaring it to HM Revenue & Customs (HMRC) if required.
In the UK, you may be entitled to a £1,000 trading allowance, but if your total income from such activities exceeds this, you must declare it via a Self Assessment tax return.
DIY Toolshare does not provide tax advice and does not withhold any amounts for tax purposes.
6. Your Responsibilities
- Owners: Ensure tools are safe, functional, and comply with UK safety standards.
- Borrowers: Return tools on time, in the same condition, and use them only for their intended purpose.
- Any damage, loss, or late return fees are agreed between users and processed via our platform.
7. Prohibited Items & Conduct
You may not list:
- Unsafe or illegal tools
- Tools requiring a professional licence to operate (unless the borrower holds that licence)
- Any item prohibited under UK law
You may not:
- Circumvent our payment system
- Provide false or misleading information
- Harass, abuse, or threaten other users
8. Liability
- We are not responsible for the condition, performance, or safety of tools.
- We are not liable for any injury, damage, or loss arising from the use of a tool.
- Users enter into rental agreements at their own risk.
9. Disputes
- We encourage users to resolve disputes directly.
- If you cannot resolve a dispute, you may contact us and we will attempt to mediate.
- We reserve the right to remove accounts that repeatedly breach these Terms.
10. Termination
We may suspend or close accounts that breach these Terms or misuse our platform.
11. Changes to These Terms
We may update these Terms at any time. We will post changes on our website, and continued use of our service means you accept the updated Terms.
